WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT

1. Release of Liability: I, the undersigned, hereby waive, release, discharge, and covenant not to sue Custos Tactical and its officers, agents, employees, and representatives (collectively and subsequently referred to as the “Releasees”) from any and all liability, claims, demands, actions, and causes of action arising from or related to any personal loss, injury, including death, or property damage that I or my property may sustain while participating in the Training, whether occurring on the premises where the Training is conducted, during transit to or from the premises, or at any other location associated with the Training. This release applies whether such injuries or damages are caused by the negligence of the Releasees or otherwise.
   
   
2. Acknowledgment of Risk: I acknowledge that I am aware of the potential risks and hazards involved in participating in the Training and being on the premises, which may include risks that are not immediately apparent. Despite these risks, I voluntarily choose to participate in the Training, enter the premises, and engage in related activities, knowing that conditions may be or may become dangerous or hazardous to me and my property. I assume full responsibility for any loss, injury, death, or property damage that may result from my participation, whether due to the negligence of the Releasees or otherwise.
   
   
3. Indemnification: I agree to indemnify, defend, and hold harmless the Releasees from any and all losses, liabilities, damages, or expenses that they may incur as a result of my participation in the Training, including any claims or actions arising from my own negligence or the negligence of others.
   
   
4. Binding Effect: It is my express intent that this Waiver of Liability shall bind my family members, spouse (if applicable), heirs, assigns, and personal representatives, whether I am alive or deceased, and shall constitute a waiver, release, discharge, and covenant not to sue the Releasees.

Intellectual Property: I understand and acknowledge that the material presented during the Training is the intellectual property of Custos Tactical and its affiliates. I agree that I will not record, reproduce, or distribute any part of the material in any form or by any means without prior written consent from Custos Tactical. Additionally, I will not share, present, or replicate the material for others without such express consent.

I confirm and agree to the following:

• A: I have read and fully understand the terms of this waiver and release, and I am signing it voluntarily as my own free act.
  
  
• B: No verbal promises, representations, or inducements have been made to me apart from this written agreement.
  
  
• C: I am at least 18 years of age and legally competent to sign this document. I execute this release with full knowledge and intention, and I intend to be bound by its terms.
